Terms of Use

These Terms of Use ("Terms") are an agreement between you and Byldflow LLC ("Byldflow", "we", "us", "our"), a Florida limited liability company. They govern your use of the GujjuCal app (the "App"), the website at gujjucal.com (the "Website") and related services (together, the "Services"). By downloading, accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Who can use GujjuCal

You must be old enough to agree to these Terms where you live, or have the permission of a parent or guardian who agrees to them for you. The Services are not directed to children under 13.

Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and to use the Website, in each case for your own non-commercial use. All rights not expressly granted to you are reserved.

For guidance, not guarantees

Tithis, festival dates, choghadiya, muhurat and other panchang details are calculated astronomically and offered for informational and religious guidance. Traditions and regional practices vary, so please confirm important dates and muhurat with your family's panchang, temple or priest before acting on them. Byldflow LLC is not responsible for decisions made based on the content of the Services.

Your data, your device

Names, punyatithi, events and settings you save in the App are stored only on your device and in any backups you make of it. You are responsible for your device and its backups. Deleting the App deletes this information from your device, and we cannot recover it.

Acceptable use

You agree not to: copy, modify, distribute, sell or lease any part of the Services; reverse engineer, decompile or disassemble the App, except where the law expressly allows it; use automated means to scrape, overload or disrupt the Services; interfere with ads, security features or other users; or use the Services for any unlawful purpose.

Ads, videos and third-party services

The App and, on wide screens, the Website show ads served by Google. The App and the Website list videos from YouTube channels and use services from Apple, Google, Open-Meteo, BigDataCloud and Vercel. Third-party content and services are governed by their own terms (for example, the YouTube Terms of Service), and we do not endorse or control them. Videos and channel content belong to their creators.

Ownership

The Services, including their design, text, articles, calculations, logos and the names GujjuCal and Byldflow, belong to Byldflow LLC or its licensors and are protected by copyright, trademark and other laws. You may not use them without our permission, except as these Terms allow.

Contacting us and feedback

When you contact us, you agree that we may reply and contact you by email about your message, as described in our Privacy Policy. If you send us suggestions or feedback, we may use them without any obligation to you.

Apple App Store terms

If you downloaded the App from Apple's App Store: • These Terms are between you and Byldflow only, not Apple. Byldflow, not Apple, is solely responsible for the App and its content. • Your use of the App must also follow the Usage Rules in the Apple Media Services Terms and Conditions. • Apple has no obligation to provide any maintenance or support for the App. • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. • Byldflow, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. • If a third party claims that the App or your use of it infringes their intellectual property rights, Byldflow, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim. • You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you. • Questions, complaints or claims about the App should be sent to us using the details under "Contact us" below.

Disclaimer of warranties

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Byldflow disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that calculated dates and times will match any particular panchang.

Limitation of liability

To the fullest extent permitted by law, Byldflow and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim (which is nothing for the free App) or US$50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. Some places do not allow certain limits, so some of them may not apply to you.

Indemnity

To the extent permitted by law, you agree to indemnify Byldflow against claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms.

Changes to the Services

We may change, suspend or stop offering any part of the Services at any time, for example to add features, fix problems or comply with the law.

Ending these Terms

You can stop using the Services at any time by deleting the App and no longer using the Website. We may suspend or end your access if you break these Terms. The sections that by their nature should continue, such as ownership, disclaimers, limitation of liability and governing law, will continue after these Terms end.

Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought only in the state or federal courts located in Florida, and you and we consent to their jurisdiction. Before bringing a claim, please contact us so we can try to resolve it informally.

If you are a consumer living in the EU, the UK or another country whose laws give you the right to bring claims in your local courts or the protection of mandatory local consumer laws, nothing in these Terms takes away those rights.

Changes to these Terms

We may update these Terms from time to time. We will change the effective date at the top, and if the changes are significant we will also let you know in the App or on the Website. If you continue to use the Services after the changes take effect, you accept the updated Terms.

General

These Terms, together with our Privacy Policy and, for App Store downloads, Apple's terms, are the entire agreement between you and Byldflow about the Services. If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them to a successor to our business. If a translation of these Terms conflicts with the English version, the English version applies.
